Osada Widokowa Kościelisko

REGULAMIN REZERWACJI I POBYTU

Osada Widokowa Kościelisko — rezerwacje, pobyt i ochrona danych

§ 1

Informacje ogólne i zawarcie umowy

  2. Usługi objęte Regulaminem świadczy GÓRSKA GRUPA HOTELOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Chyców Potok 26/2, 34-500 Zakopane, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy dla Krakowa-Śródmieścia w Krakowie, XII Wydział Gospodarczy KRS, pod numerem KRS 0001095970, NIP 7361748232, zwana dalej „Wynajmującym”. Kontakt: recepcja@osadawidokowa.pl, tel. +48 696 773 773. Adres recepcji: ul. Nędzy Kubińca 141, 34-511 Kościelisko.
  3. „Gość” oznacza osobę zawierającą umowę o pobyt albo korzystającą z Apartamentu, stosownie do danego postanowienia. Rezerwacji dokonuje osoba pełnoletnia posiadająca pełną zdolność do czynności prawnych lub upoważniony przedstawiciel podmiotu zawierającego umowę. Osoby małoletnie przebywają pod opieką osoby dorosłej.
  4. Przed zawarciem umowy Gość otrzymuje informacje o wybranym Apartamencie, terminie pobytu, liczbie osób, istotnych cechach usługi, całkowitej cenie i opłatach dodatkowych, płatnościach, kaucji oraz warunkach zmiany i anulowania rezerwacji.
Opis i zdjęcia powinny odpowiadać zarezerwowanemu Apartamentowi i istotnym cechom usługi.
§ 2

Rezerwacja, płatności i opłata miejscowa

§ 4

Anulowanie rezerwacji i zwroty

§ 5

Zasady pobytu

Przyjazd i wyjazd

Ewentualna dodatkowa opłata wymaga uprzedniego przedstawienia i akceptacji. Przy późnym przyjeździe brakujące formalności należy dopełnić w recepcji następnego dnia do 12:00, zgodnie z otrzymaną instrukcją.

Spokój i bezpieczeństwo

  1. Cisza nocna obowiązuje od 22:00 do 6:00. Przez całą dobę należy szanować spokój innych osób. Organizowanie imprez w Apartamentach i częściach wspólnych jest zabronione.

Wyposażenie, szkody i sprzątanie

Dzieci i ochrona małoletnich

Usterki, awarie i świadczenie zastępcze

  1. Usterkę należy zgłosić recepcji. Wynajmujący podejmuje działania naprawcze bez zbędnej zwłoki, informując o przewidywanym czasie i dostępnych rozwiązaniach. Dostęp do Apartamentu w celu naprawy jest uzgadniany z Gościem, z wyjątkiem sytuacji nagłego zagrożenia wymagających niezwłocznej interwencji.
Przeniesienie wymaga zgody Gościa i uzgodnienia warunków; brak zgody nie pozbawia go ustawowych roszczeń.

Rzeczy Gościa i odpowiedzialność Wynajmującego

Reklamacje i pomoc w sporach

INFORMACJE O PRZETWARZANIU DANYCH OSOBOWYCH

Poniższe informacje dotyczą obsługi rezerwacji i pobytu. RODO oznacza rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679.

  1. Administrator i kontakt.

  3. Cele i podstawy prawne. Przyjęcie i obsługa rezerwacji, kontakt dotyczący pobytu, wykonanie umowy i obsługa płatności opierają się na art. 6 ust.

  7. System Guesty i przetwarzanie poza EOG.

MONITORING WIZYJNY

  1. Administrator i kontakt.

  2. Cel i podstawa prawna. Monitoring służy ochronie osób i mienia oraz zabezpieczeniu materiału dotyczącego zdarzeń naruszających bezpieczeństwo. Podstawą przetwarzania jest art. 6 ust. 1 lit. f RODO — prawnie uzasadniony interes administratora monitoringu polegający na zapewnieniu bezpieczeństwa i ochronie mienia, z poszanowaniem praw i wolności osób obserwowanych.

  3. Zakres monitoringu.

  4. Przechowywanie i zabezpieczenie nagrań.

  5. Dostęp i odbiorcy.

  6. Dostęp do własnych danych. Prawo dostępu i otrzymania kopii danych jest realizowane z poszanowaniem praw i wolności innych osób, w razie potrzeby z zastosowaniem zabezpieczeń, w szczególności zasłonięcia wizerunków innych osób. Wniosek o dostęp do własnych danych lub zabezpieczenie nagrania powinien zawierać informacje umożliwiające odnalezienie materiału, w szczególności przybliżoną datę, godzinę i miejsce zdarzenia.

  7. Prawa osób nagranych i termin odpowiedzi.

12 ust. 5 i art. 15 ust. 3 RODO.

  9. Przerwy techniczne, sanitarne lub wynikające z zagrożenia mogą wymagać czasowego zamknięcia Strefy lub części urządzeń. Goście są informowani o znanych ograniczeniach przed rezerwacją, a o późniejszych przeszkodach bez zbędnej zwłoki. 4.
  5. Wersje polska i angielska przedstawiają te same warunki.

BOOKING AND STAY TERMS AND CONDITIONS

Osada Widokowa Kościelisko — bookings, stays and data protection

§ 1

General information and conclusion of the agreement

  1. These Terms and Conditions set out the rules for booking and short-term accommodation in the apartments at Osada Widokowa Kościelisko, ul. Nędzy Kubińca 141–141e, 34-511 Kościelisko, hereinafter referred to as the “Apartments”. Information and offers are available on the website www.osadawidokowakoscielisko.pl, hereinafter referred to as the “Portal”.
  2. The services covered by these Terms and Conditions are provided by GÓRSKA GRUPA HOTELOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Chyców Potok 26/2, 34-500 Zakopane, entered in the register of entrepreneurs of the National Court Register maintained by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register, under KRS number 0001095970, NIP 7361748232, hereinafter referred to as the “Landlord”. Contact: recepcja@osadawidokowa.pl, telephone: +48 696 773 773. Reception address: ul. Nędzy Kubińca 141, 34-511 Kościelisko.
  3. “Guest” means the person entering into the agreement for the stay or using the Apartment, as appropriate to the provision concerned. A booking must be made by an adult with full legal capacity or an authorised representative of the entity entering into the agreement. Minors must remain under the supervision of an adult.
  4. Before entering into the agreement, the Guest receives information about the selected Apartment, the dates of the stay, the number of guests, the main features of the service, the total price and additional charges, payments, the security deposit, and the terms for amending and cancelling the booking. These Terms and Conditions are made available in a form that allows them to be saved and reproduced. Individual terms apply if they have been expressly agreed with the Guest before the agreement is concluded; they may not restrict the Guest’s rights under mandatory provisions of law.
  5. The agreement is concluded once the Landlord has accepted the booking and confirmed its terms on a durable medium, in particular by email. An acknowledgement of receipt of an enquiry does not in itself constitute acceptance of the booking if it has been expressly stated that approval is required. The confirmation of the agreement includes its agreed terms and the text of these Terms and Conditions. For bookings made through an external booking platform, the terms of the offer presented and accepted through that channel also apply.
  6. The price agreed when the agreement is concluded does not increase as a result of a subsequent change to the price list. The description and photographs should correspond to the booked Apartment and the main features of the service. Differences in decorations do not exclude liability for a service that does not conform to the agreement.
§ 2

Bookings, payments and the local tourist tax

  1. Bookings may be made through the Portal, by email or by telephone, using the contact details in § 1. The information necessary to process the booking must be provided, in particular the Guest’s first name and surname, contact details, the dates of the stay and the number of guests, including the ages of children where these affect the conditions of the stay. Invoice details are required where the Guest requests an invoice and those details are necessary to issue it.
  2. For online bookings, the obligation to pay must be clearly indicated before the order is placed. Additional services for which a charge is payable require the Guest’s prior, express consent. The Guest may not be charged a fee of which they were not informed before entering into the agreement or which they have not subsequently expressly accepted.
  3. As a general rule, an advance payment of 100% of the price is required before the stay begins and is payable when booking, unless a different payment schedule has been agreed before the agreement is concluded. The payment is credited towards the price of the stay and does not constitute earnest money within the meaning of Article 394 of the Polish Civil Code. The rules for settling this payment are set out in § 4. The payment method, deadline and amount are specified before the agreement is concluded and in its confirmation.
  4. If payment of part of the price on arrival has been agreed, the Guest must pay the outstanding balance no later than check-in. The Landlord confirms receipt of payments. Before terminating a concluded agreement due to late payment, the Landlord sets an appropriate additional deadline, unless applicable law permits another course of action. Failure to pay does not in itself entitle the Landlord to retain amounts already received at its discretion.
  5. The Flexible Offer provides for free cancellation under § 4. An offer without free cancellation, described as “non-refundable”, may have a different price and requires payment of 100% of the price in advance. The Guest must make an informed choice, and the consequences of cancellation must be explained before the agreement is concluded. The name of the offer does not exclude rights arising from non-performance or improper performance of the service.
  6. Before booking, the Guest receives information about whether the dates fall within the low season, high season or a special period, and the specific deadline for free cancellation. General descriptions such as “public holidays”, “school holidays”, “long weekend”, “New Year” or “summer holidays” do not replace the requirement to specify the terms for the selected stay. Cancellation terms may not be made more restrictive unilaterally after the agreement has been concluded.
  7. The price includes the agreed services and utility charges. Mandatory cleaning or service charges, if applicable to a particular offer, must be included in the total price presented. The scope and prices of additional services are specified before they are ordered.
  8. The local tourist tax is collected only where, and to the extent, required by the rules applicable to the location and dates of the stay, taking exemptions into account. Information about the rate, calculation and collection of the tax is provided before booking, based on the law in force at that time. If the rate for a future date has not yet been adopted, this must be clearly indicated; the previous year’s rate is not treated as guaranteed. Amounts collected towards the tax are subject to proper settlement, and any overpayment is refunded. A receipt is issued for the tax collected.
  9. A security deposit of PLN 500 is required at check-in, in accordance with the “Security deposit” section in § 5. The form of security is explained to the Guest before the agreement is concluded.
§ 3

Booking amendments

  1. Any change to the dates, Apartment, number of guests or other terms requires agreement with the Landlord, is subject to availability, and requires confirmation of the new terms on a durable medium. Any additional payment is specified before the change is accepted. An enquiry about a change does not in itself cancel the existing booking.
  2. The Guest may nominate another person to take over the booking together with its rights and obligations, provided that the necessary details are supplied and the other person confirms that they are taking over the booking. The Landlord confirms the booking update. No information beyond what is necessary to process the booking is required.
§ 4

Booking cancellations and refunds

  1. For an agreement concerning accommodation on a specified date or during a specified period, the consumer does not have the statutory 14-day right to withdraw from a distance contract, under Article 38(1)(12) of the Polish Consumer Rights Act. This does not restrict the contractual cancellation right set out below or other rights provided by law.
  2. Cancellation may be notified by email to recepcja@osadawidokowa.pl or by telephone. Email is recommended to make it easier to confirm the time of notification. The Landlord acknowledges receipt of the notification on a durable medium; the time of cancellation is determined by when the Guest’s notice is received, not by when the reply is sent.
  3. Under the Flexible Offer, the Guest receives a full refund of the advance payment if the stay is cancelled at least 14 days before its scheduled start in the low season, or at least 30 days before its scheduled start in the high season or a special period. The exact deadline is specified before the agreement is concluded. If the longer notice period has not been clearly presented and agreed, the 14-day period applies. More favourable terms of an individual offer remain in force.
  4. If a booking is made after the deadline for free cancellation, the Guest must be clearly informed of this before making the booking. Such a booking does not receive a new free cancellation period unless otherwise agreed.
  5. After the free cancellation deadline, in the event of a no-show or voluntary early departure, the Landlord may settle justified amounts due in accordance with the law. The amount payable for the unused part of the stay may not exceed either the proven loss that is a normal consequence of the Guest’s failure to perform the agreement or the price of that part of the stay. Expenses saved and revenue from reselling the released dates are taken into account. The Landlord takes reasonable steps to mitigate the loss and provides the Guest with a statement of the settlement. Cancellation does not in itself result in the automatic forfeiture of 100% of the payment.
  6. For an offer without free cancellation, the settlement rules set out in clause 5 apply from the time the agreement is concluded. This provision does not entitle the Landlord to charge fees that were not disclosed before booking or to retain funds for a service that the Landlord was unable or unwilling to provide.
  7. Amounts indisputably due to the Guest are refunded without undue delay, no later than within 14 calendar days of the basis for the refund being established; for free cancellation, this period runs from receipt of the cancellation notice. The refund is made using the same payment method as the original payment, unless the Guest expressly agrees to a different method that incurs no additional costs for them. The Landlord may not delay the undisputed part of a refund because of a dispute over the remaining amount.
  8. The cancellation terms do not restrict the Guest’s rights in the event of non-performance of the agreement, defects in the service, impossibility of performance or other circumstances in which the law provides a right to a refund, price reduction, termination of the agreement or compensation. In such cases, the applicable legal provisions apply instead of an automatic charge for voluntary cancellation.
§ 5

Rules of stay

Arrival and departure

  1. The Apartment is available from 16:00 on the day of arrival until 11:00 on the day of departure. Check-in and collection of keys or access cards take place at the reception desk of Osada Widokowa Kościelisko, ul. Nędzy Kubińca 141, from 16:00 to 20:00, unless another arrangement has been agreed.
  2. Arrival after 20:00 must be agreed with reception in advance, where possible at least 24 hours before arrival. Any additional charge must be disclosed and accepted beforehand. Following a late arrival, any outstanding formalities must be completed at reception by 12:00 the next day, in accordance with the instructions received.
  3. At check-in, the Guest must present an identity document to the extent necessary to verify the booking, pay the outstanding balance and any agreed charges, and provide the security deposit. Identity documents are neither retained nor copied for the routine administration of the stay. If a booking has been made by a minor without the required legal representation, the situation must be clarified with their legal representative; age alone does not justify the automatic forfeiture of payments.
  4. Early check-in, late check-out and extensions of the stay depend on availability and prior confirmation by reception. The price for additional time is agreed before consent is given. Requests to extend a stay should preferably be made no later than the day before departure.
  5. On departure, keys or access cards must be returned to reception or in another agreed manner. Remaining in the Apartment after the agreed time without permission does not automatically extend the booking. Any claims by the Landlord require a legal basis and evidence of the amount claimed.
  6. If belongings are left behind after departure, the Landlord attempts to contact the Guest and safeguards the items in accordance with the law. Entry into an Apartment that remains occupied must respect the Guest’s privacy and have a legal basis, except where immediate action is necessary to protect life, health or property.

Security deposit

  1. The security deposit is PLN 500 and is generally provided through a payment card pre-authorisation, meaning a temporary hold on funds. Another form is possible only by prior agreement. The security deposit is neither payment for the stay nor an automatic charge for a breach of these Terms and Conditions.
  2. The security deposit may secure only legitimate amounts due in connection with the stay, particularly liability for damage for which the Guest is responsible under the law. Before settling any amount against the deposit, the Landlord provides the basis and calculation of the amount due and the available evidence, allowing the Guest to present their position. Charging the card also requires compliance with the applicable payment authorisation rules. The Guest retains the right to dispute the charge.
  3. An instruction to release the unused portion of the hold is issued promptly after the Apartment has been inspected and the stay has been settled, no later than 7 working days after departure. The time at which the funds become available in the account also depends on the bank and payment service provider. An unsettled claim does not justify holding the entire security deposit indefinitely. If a cash deposit has been agreed, the unused amount is returned no later than within the same period.

Parking

Vehicles must be parked in the space allocated to the Apartment or designated by staff, without obstructing access or evacuation routes. The vehicle must be registered with reception; its registration number is used to organise parking. The selected offer specifies the parking spaces included in the price. Liability for vehicles and belongings left in them is governed by applicable law and the scope of the service actually provided.

Peace and safety

  1. Quiet hours apply from 22:00 to 6:00. Other people’s peace must be respected at all times. Parties in the Apartments and common areas are prohibited.
  2. In the event of a breach, staff may require the inappropriate behaviour to stop. In the case of a serious or persistent breach, particularly one that threatens safety, the Landlord may take measures permitted by law, including contacting the appropriate services or terminating the contract where statutory or validly agreed grounds exist. Termination of the contract does not automatically result in the forfeiture of the entire payment; settlement takes account of services provided and legally justified claims.
  3. The number of people using the Apartment must not exceed either the agreed number or its permitted capacity. Additional occupants require consent and prior agreement on any extra charge. The Guest is responsible for their own conduct and that of persons for whom they are legally responsible.

Equipment, damage and cleaning

  1. The Guest must use the Apartment and its equipment for their intended purposes and in accordance with safety instructions. Liability for damage is governed by applicable law. The Guest is not liable for normal wear and tear, pre-existing damage or circumstances for which they are not responsible.
  2. Any damage, missing items or discrepancies noticed must be reported as soon as possible so that they can be remedied. Failure to report them on the day of arrival does not constitute a waiver of rights or confirmation that the Apartment was free from defects.
  3. If a key or access card is lost or damaged through the Guest’s fault, the Guest may be charged the justified and evidenced cost of replacement and restoration of access, up to PLN 200. Additional cleaning required because of soiling caused through the Guest’s fault and exceeding normal use is charged at the evidenced, justified cost, up to PLN 500. Routine cleaning after a stay is not such an additional cost.
  4. A claim for damages requires evidence of the basis of liability and the amount of the loss. Lost profits are not charged automatically. The Guest may not be charged multiple times for the same damage under different descriptions.
  5. Doors and windows must be secured when leaving. Furniture must not be moved without agreement from staff, and equipment must not be used in a manner that creates a safety risk. Guests must not use their own heating or cooking appliances that are not part of the Apartment’s equipment without staff consent. Personal devices in good working order may be used in accordance with their instructions, including chargers, laptops, hairdryers and shavers.

No smoking

Smoking, including the use of electronic cigarettes, is prohibited in the Apartments and indoor common areas. Cigarette ends and other waste must not be thrown out of windows or from balconies. A breach may result in liability for evidenced remedial costs and other damage under the general rules of law.

Pets — in selected Apartments only

  1. Pets are accepted in selected Apartments only. Before making a booking, reception must be informed of the type and number of animals, and confirmation must be obtained that they can stay in the specific Apartment. An Apartment being available to book does not automatically mean that pets are permitted.
  2. The charge for an agreed stay with a pet is PLN 40 per day, unless the selected offer provides more favourable terms. The total charge, taking into account the declared number of animals and length of stay, is disclosed before the contract is concluded. Acceptance of the animal and the charge must be included in the booking confirmation.
  3. The person responsible for the animal must supervise it, clean up after it and prevent disturbances or hazards. In common areas, dogs should be kept on a lead, with a muzzle used where required by law or for safety. Liability for damage caused by an animal is governed by applicable law.
  4. Arrival with an animal whose stay has not been agreed does not guarantee accommodation in the booked Apartment. Reception may offer an available Apartment that accepts pets, subject to prior agreement on any price difference. If this is not possible, the matter is settled in accordance with the contract and the law, without an automatic penalty or forfeiture of the entire payment.
  5. The above restrictions do not affect the statutory rights of persons using an assistance dog or other persons entitled under Article 20a of the Polish Act on Vocational and Social Rehabilitation and Employment of Persons with Disabilities. The requirement for consent to a pet does not replace those rights. No pet fee is charged for an assistance dog; the relevant statutory conditions apply, including the exceptions relating to leads and muzzles.

Children and safeguarding of minors

  1. One child under 2 years of age per two adults may stay without an additional accommodation charge if they sleep with the adults or in their own cot and do not require additional bed linen. The child’s stay must be declared when booking. Requests for a cot or additional services require confirmation of availability and price.
  2. Children must use the playground and other facilities under adult supervision, in accordance with signage and safety rules. The duty of supervision does not exclude the Landlord’s liability for the condition of the equipment or the proper provision of services.
  3. To safeguard minors, it must be possible at check-in to establish the child’s identity and their relationship with the accompanying adult. Verification should be based on documents presented for inspection or other reliable information, as appropriate to the circumstances. The data collected are limited to the necessary minimum; documents are neither copied nor retained. A reasonable suspicion that a child’s welfare is at risk requires protective action, including notifying the appropriate services where necessary.

Defects, breakdowns and alternative accommodation

  1. Defects must be reported to reception. The Landlord takes remedial action without undue delay, providing information about the expected timeframe and available solutions. Access to the Apartment for repairs is agreed with the Guest, except in emergencies requiring immediate intervention.
  2. A failure of utilities, Internet access or equipment does not automatically exclude the Guest’s rights. The consequences of a defect, the extent of any service not provided and the parties’ liability are assessed in accordance with the contract and the law, including in relation to a price reduction, refund or termination of the contract.
  3. If the agreed Apartment cannot be provided, the Landlord may offer suitable alternative accommodation. Relocation requires the Guest’s consent and agreement on the terms; withholding consent does not deprive the Guest of statutory claims. Payments for services not provided are refunded in accordance with § 4.
  4. Force majeure or another event beyond the parties’ control does not entitle the Landlord to retain payment for a service that has not been provided where the law requires its refund. Settlement for the part already provided and the parties’ further rights depend on applicable law and the actual extent of the services provided.

The Guest’s belongings and the Landlord’s liability

The Landlord’s liability for the loss of or damage to the Guest’s belongings and for non-performance or improper performance of the contract is governed by applicable law. These Terms and Conditions do not exclude or limit liability that cannot lawfully be excluded, particularly liability under the provisions governing hotels and similar establishments where those provisions apply. Damage or missing belongings must be reported promptly upon discovery. Arrangements for collecting or returning items left behind after departure are agreed with the person entitled to them; any shipping cost requires that person’s acceptance.

Complaints and assistance with disputes

  1. Complaints concerning bookings, stays, billing or the operation of the Portal may be submitted by email to recepcja@osadawidokowa.pl, in writing to the Landlord’s address, or at reception. It is recommended that the complaint include details identifying the booking, a description of the problem and the requested resolution. The absence of a form, or of a document not required by law, does not in itself justify refusing to consider the complaint.
  2. The Landlord responds to the consumer on a durable medium within 14 days of receiving the complaint, unless a specific legal provision provides otherwise. The consequences of failing to respond are governed by law, including Article 7a of the Polish Consumer Rights Act. Reporting a problem after departure does not exclude the right to submit a complaint; reporting it promptly during the stay makes it easier to remedy the issue.
  3. Consumers may seek assistance from a municipal or district consumer ombudsman and obtain information about alternative dispute resolution at polubowne.uokik.gov.pl. If a complaint is rejected, the Landlord provides the legally required statement concerning participation in the appropriate alternative dispute resolution proceedings. This provision does not limit the right to bring proceedings before a court.

INFORMATION ON THE PROCESSING OF PERSONAL DATA

The following information concerns the handling of bookings and stays. GDPR means Regulation (EU) 2016/679 of the European Parliament and of the Council.

  1. Controller and contact details. The controller of personal data processed in connection with accepting and handling bookings and stays is GÓRSKA GRUPA HOTELOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Chyców Potok 26/2, 34-500 Zakopane, tax identification number (NIP): 7361748232. For data protection matters, please contact rodo@gorskagrupa.pl or write to the address above.

  2. Categories of data. Data processed in connection with a booking include the Guest’s identification and contact details, information about the booking and stay, payments and financial settlements, and correspondence relating to these matters. The data collected must be limited to information necessary for the specific purpose. Invoice details and other data required by law are collected to the extent required by the relevant legal obligation.

  3. Purposes and legal bases. Accepting and handling bookings, communicating about a stay, performing the contract and handling payments are based on Article 6(1)(b) GDPR — entering into and performing the contract and taking steps at the Guest’s request before entering into it. Compliance with tax and accounting obligations, including issuing and retaining financial records and handling the local tourist tax to the extent required, is based on Article 6(1)(c) GDPR in conjunction with the applicable tax and accounting legislation. Establishing, exercising or defending claims relating to bookings and stays is based on Article 6(1)(f) GDPR; the Controller’s legitimate interest is the protection of its rights. Where organising a stay requires the data of a person included in the booking who is not a party to the contract, the processing is based on Article 6(1)(f) GDPR — the legitimate interest in properly organising and providing that person’s stay. Where data are obtained from another person or an intermediary, the Controller fulfils its information obligations under Article 14 GDPR, including identifying the source of the data.

  4. Providing data. Providing data marked as required during the booking process is necessary to enter into and perform the contract or to fulfil the stated legal obligation. Failure to provide data necessary for a booking may prevent it from being accepted. Providing other data is voluntary.

  5. Marketing communications. Making a booking and accepting these Terms and Conditions do not constitute consent to receive commercial communications. If the Controller conducts marketing communications, it processes data for that purpose on the basis of voluntary consent (Article 6(1)(a) of the GDPR), separate from acceptance of these Terms and Conditions. Data used for that purpose is retained until consent is withdrawn or the processing purpose ceases earlier; further retention of data necessary to demonstrate compliance with the law requires a separate legal basis and must be limited to the necessary period. Any such communications sent through channels covered by Article 398 of the Polish Electronic Communications Law require prior consent given in accordance with that provision. Refusing or withdrawing marketing consent does not affect the ability to book or complete a stay. Messages necessary to handle a booking and perform the contract are separate from marketing communications.

  6. Recipients of data. To the extent necessary for the stated purposes, data may be disclosed to providers of booking and IT systems, including Guesty, hosting and email providers, payment service providers and banks, providers supporting the delivery of the stay, and accounting and legal service providers. The extent of disclosure depends on the service provided. Processors acting on the Controller’s behalf operate under an appropriate agreement and in accordance with its documented instructions. Data are also disclosed to authorised bodies where required by law.

  7. The Guesty system and processing outside the EEA. The Guesty system is used to handle bookings. This provider’s public documents describe data processing in various countries, including the United States and Israel, and safeguards for international data transfers. Guesty’s data processing addendum provides for standard contractual clauses for transfers covered by it that require such safeguards. The provider’s documents are available here: Guesty Privacy Policy and Guesty Data Processing Addendum. Transfers outside the European Economic Area require a legal basis consistent with Chapter V GDPR. When collecting data, the Controller must provide information about the applicable transfers and the existence or absence of a relevant European Commission adequacy decision and, where safeguards are used, those safeguards and how to obtain a copy or where they are available. Enquiries may be sent to rodo@gorskagrupa.pl.

  8. Retention period. Data needed to handle a booking are retained for the duration of its fulfilment and financial settlement. After that, only data necessary to comply with legal obligations or to establish, exercise or defend claims are retained. Tax records are retained until the applicable limitation period for tax liabilities expires, taking account of events affecting that period, and accounting records are retained for the period required by accounting legislation. Data needed for claims are retained until the relevant limitation period expires or, where proceedings are ongoing, for as long as necessary to conclude them and give effect to the outcome. Data for which there is no longer a purpose or legal basis for further processing must be erased or effectively anonymised.

  9. Data subject rights. Subject to the conditions laid down in the GDPR, individuals have the rights to access their data and receive a copy, to rectification, erasure and restriction of processing, and, where provided for by the GDPR, to data portability. Processing based on legitimate interests may be objected to on grounds relating to the individual’s particular situation. Processing for direct marketing purposes may be objected to at any time. Where processing is based on consent, consent may be withdrawn at any time without affecting the lawfulness of earlier processing. Individuals also have the right to lodge a complaint with the President of the Polish Personal Data Protection Office. Requests concerning data processed by the Controller may be submitted using the contact details above.

VIDEO SURVEILLANCE

  1. Controller and contact details. The controller of surveillance data is Wspólnota Mieszkaniowa OSADA WIDOKOWA 1 KOŚCIELISKO, ul. Nędzy Kubińca 141–141e, Kościelisko. Requests concerning recordings and data subject rights should be addressed to the Management Board of this property owners’ association at its stated address. Reception may assist in forwarding a request to the association; this does not replace the surveillance controller’s responsibility to deal with the request.

  2. Purpose and legal basis. Video surveillance is used to protect people and property and to preserve material relating to incidents affecting safety or security. Processing is based on Article 6(1)(f) GDPR — the surveillance controller’s legitimate interest in ensuring safety and protecting property, while respecting the rights and freedoms of individuals being observed.

  3. Scope of surveillance. Surveillance operates around the clock and records images from cameras in marked common areas: around the buildings, at entrances, in corridors and waste storage rooms, and in other marked common areas. Sound is not recorded. The surveillance controller must provide signs identifying the area covered by cameras and access to full information about the processing of data before individuals enter that area.

  4. Retention and preservation of recordings. Recordings are retained for no longer than 7 days from the time they are made. Where a specific recording is necessary to investigate an incident or to establish, exercise or defend claims, or constitutes evidence in proceedings, the relevant excerpt may be preserved for as long as necessary for that purpose, subject to an appropriate legal basis. The preserved material must be erased once its further retention is no longer necessary. Preserving material concerning one incident does not justify extending the retention of other recordings.

  5. Access and recipients. Access to the system and recordings may be granted only to authorised persons and providers acting for the surveillance controller, on an appropriate legal basis and to the extent necessary. Recordings must be protected against unauthorised access and disclosure, loss and destruction. Disclosures and the creation of copies should be documented. Recordings may be disclosed to competent authorities under applicable law and to data subjects when exercising their rights under the GDPR.

  6. Access to personal data. The rights of access and to receive a copy of data are exercised with due regard to the rights and freedoms of others, using safeguards where necessary, in particular obscuring other individuals’ images. The presence of other people in a recording does not automatically justify refusing to consider a request. A request for access to one’s own data or for a recording to be preserved should include information enabling the relevant material to be located, in particular the approximate date, time and location of the incident. Given the limited retention period, requests should be submitted promptly. This recommendation does not restrict the rights or time limits provided for by the GDPR.

  7. Rights of recorded individuals and response time. Subject to the conditions laid down in the GDPR, individuals whose data are processed through surveillance have the rights to access their data, obtain a copy, request rectification, erasure or restriction of processing, object on grounds relating to their particular situation, and lodge a complaint with the President of the Polish Personal Data Protection Office. The controller must provide information on action taken in response to a request without undue delay and no later than one month after receiving it. This period may be extended by a further two months in the circumstances specified in Article 12(3) GDPR; in that case, the controller must notify the individual of the extension and the reasons for it within the first month.

  8. Fees. Exercising data subject rights and receiving the first copy of data are generally free of charge. A fee may be charged only in the circumstances permitted by the GDPR, in particular for further copies or for manifestly unfounded or excessive requests, subject to the conditions in Article 12(5) and Article 15(3) GDPR.

§ 6

Wellness Area

  1. The Wellness Area is available to Guests of Osada Widokowa Kościelisko as part of the accommodation price, from 14:00 to 22:00. A time slot must be agreed with reception in advance; if a slot is available, it may be booked immediately before entry.
  2. Sessions start on the hour during opening hours and last 55 minutes. Guests from a maximum of two Apartments may use the Area at the same time, subject to the permitted capacity of each facility; the hot tub accommodates a maximum of 6 people. A booking for one Apartment does not provide exclusive use. Extensions require reception's approval and availability.
  3. The Area is intended for quiet relaxation. Disturbing others, playing loud music, or photographing or filming other people without their consent is prohibited. Guests must respect others' privacy.
  4. Before entering, Guests must shower and change into flip-flops or other suitable footwear. Swimwear is required, and towels must be used in accordance with the instructions for each facility. Clothes and small belongings may be stored in the designated lockers. Liability for belongings is governed by law; using the Area does not waive any claims.
  5. Smoking, consuming alcohol, using intoxicating substances, bringing glass, chewing gum, running and jumping into the hot tub are prohibited. Facilities must not be used while under the influence of alcohol or intoxicating substances.
  6. Guests must follow equipment instructions and reasonable safety directions. A facility must not be used if a person's health or an identified contraindication creates a safety risk. Open wounds and infectious skin conditions prevent use of water facilities until the risk has ceased. Anyone feeling unwell should stop using the facilities and notify staff.
  7. Persons under 18 must remain under constant adult supervision in the Area and must not use the sauna. The supervising adult must ensure that use of other facilities is appropriate to the child's age, the instructions and safety rules.
  8. Faults, accidents and other hazards must be reported to staff immediately. Staff may stop use of a facility or require a person to leave the Area where necessary for safety or in response to a serious or persistent breach of the rules. Liability for damage is assessed individually under the law; booking a time slot does not itself make the person booking responsible for everyone present in the Area.
  9. Technical work, sanitary requirements or safety risks may require temporary closure of the Area or individual facilities. Guests are informed of known restrictions before booking and of subsequent problems without undue delay. Restricted availability does not exclude rights arising from failure to provide an agreed service.
§ 7

Portal and final provisions

  1. Using the Portal and booking form requires Internet access, an up-to-date browser supporting the form and an email address for receiving confirmation. The Portal's electronic features are free to use, apart from the accommodation services ordered and Internet access charges under the Guest's agreement with their provider. The Guest may stop browsing or completing an unsubmitted form at any time; this does not cancel an accommodation contract that has already been concluded.
  2. Submitting unlawful content, infringing other people's rights, or taking actions that compromise the Portal's security or operation is prohibited. Complaints about electronic services are handled in accordance with § 5.
  3. The contract is governed by Polish law. This choice of law does not deprive a consumer of the protection of mandatory provisions applicable under the relevant rules of law, including European Union law. Disputes are heard by the court having jurisdiction under applicable law.
  4. Each booking is governed by the version of these Terms and Conditions supplied and accepted when the contract was concluded. A new version published on the Portal applies to new contracts and does not automatically change existing bookings. Changes to an existing contract require the parties' agreement unless the right to make a change follows from mandatory law.
  5. The Polish and English versions set out the same terms. Any ambiguity in standard contract terms is interpreted in accordance with applicable law, taking consumer protection into account. Neither language version is used to restrict rights granted to the Guest in the accepted offer.
  6. These Terms and Conditions apply to new contracts from the date of publication. They do not exclude or restrict any rights that cannot lawfully be excluded or restricted.
